University of California, Santa Barbara Mobility Transport Program Terms of Use

IMPORTANT NOTICE: These Terms of Use are provided as a template and should be reviewed and approved by the University of California, Santa Barbara Office of General Counsel before implementation.
1. Agreement to Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you and the Regents of the University of California, on behalf of the University of California, Santa Barbara ("UCSB," "University," "we," "us," or "our"), governing your access to and use of the Mobility Transport Program, including our transportation services, mobile applications, websites, reservation systems, and related services (collectively, the "Services").
By registering for or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and by the Mobility Transport Program Privacy Policy, which is incorporated by reference.
If you do not agree to these Terms, you may not use the Services.
Changes to These Terms
UCSB reserves the right to modify these Terms at any time. Material changes will be communicated through the Mobility Transport Program website, email, or in-app notification. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
2. Description of Services
The UCSB Mobility Transport Program provides on-campus and University-approved transportation services for eligible students with mobility limitations.
Services may include:
- Mobile application for requesting transportation
- Scheduled and on-demand transportation
- Accessible vehicles
- Transportation provided through University-authorized personnel and contracted transportation providers
- Ride scheduling and dispatch services
Technology Platform
The Mobility Transport Program utilizes technology provided by Via Transportation, Inc. for trip scheduling, dispatching, and rider communications. Via provides the technology platform only. UCSB remains solely responsible for administration of the Mobility Transport Program and transportation services.
3. Eligibility and User Accounts
Program Eligibility
The Mobility Transport Program is available only to currently enrolled UCSB students who have been approved to participate through the University's established disability accommodation process for mobility-related limitations.
Participation may require verification of eligibility through the appropriate University office.
UCSB reserves the right to suspend or terminate eligibility if a participant no longer meets program requirements.
Account Registration
To use the Services, you must:
- Be an approved participant in the Mobility Transport Program.
- Register using your UCSB credentials or other approved registration process.
- Provide accurate and current information.
- Maintain the confidentiality of your account credentials.
- Promptly update your contact information.
- Notify UCSB of any unauthorized use of your account.
You are responsible for all activity occurring under your account.
4. Fees
The Mobility Transport Program is provided at no charge to approved participants unless otherwise announced by UCSB.
If future fees are implemented, participants will be notified in advance.
Cancellations and No-Shows
Participants should cancel rides as early as possible if transportation is no longer needed.
Repeated late cancellations or no-shows may result in temporary suspension or review of program eligibility to ensure equitable access for all eligible riders.
5. Acceptable Use
You agree not to:
- Use the Services for unlawful purposes.
- Share your account with another individual.
- Schedule rides for individuals who are not approved participants.
- Provide false or misleading information.
- Abuse, threaten, or harass drivers, dispatch personnel, or other riders.
- Damage University or contractor vehicles.
- Interfere with the operation of the Services.
- Attempt unauthorized access to University or Via systems.
Violation of these Terms may result in suspension or termination from the Mobility Transport Program.
6. Rider Conduct and Safety
To promote the safety of all riders and drivers, participants agree to:
- Wear seat belts whenever available.
- Follow reasonable driver instructions.
- Treat drivers and fellow passengers respectfully.
- Refrain from smoking, vaping, consuming alcohol, or using illegal drugs in University vehicles.
- Avoid conduct that creates safety hazards.
Personal Care Attendants and Guests
Approved personal care attendants may accompany eligible riders when authorized as part of the participant's approved transportation accommodation.
Guests who are not approved attendants are permitted only if consistent with Mobility Transport Program policies and available vehicle capacity.
Service Animals
Service animals are permitted in accordance with the Americans with Disabilities Act (ADA).
7. Accessibility
The Mobility Transport Program is committed to providing transportation accommodations for students with mobility-related disabilities in accordance with:
- The Americans with Disabilities Act (ADA)
- Section 504 of the Rehabilitation Act of 1973
- Applicable University of California policies
Transportation accommodations are limited to those approved through the University's established disability accommodation process.
Questions regarding accommodations should be directed to the appropriate UCSB disability services office.
8. Intellectual Property
The Mobility Transport Program, its websites, mobile applications, content, graphics, logos, and materials are owned by or licensed to UCSB or its licensors and are protected by applicable intellectual property laws.
Participants receive a limited, non-exclusive, non-transferable license to use the Services solely for their intended purpose.
9. Disclaimer of Warranties
The Services are provided on an "AS IS" and "AS AVAILABLE" basis.
While UCSB strives to provide reliable transportation, the University does not guarantee uninterrupted availability, specific arrival times, or error-free operation of the Services.
Transportation availability may be affected by weather, emergencies, traffic conditions, mechanical issues, staffing, or other unforeseen circumstances.
10. Limitation of Liability
Nothing in these Terms limits liability where prohibited by applicable law.
To the fullest extent permitted by California law, UCSB, the Regents of the University of California, their officers, employees, agents, contractors, and affiliates shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of the Services.
Nothing in these Terms shall waive any immunities, defenses, or protections available to the Regents of the University of California under applicable law.
11. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of California.
Any legal action arising under these Terms shall be brought in a court of competent jurisdiction located in the State of California, subject to applicable California and federal law governing claims against the Regents of the University of California.
12. Termination
UCSB may suspend or terminate participation in the Mobility Transport Program if a participant:
- No longer meets eligibility requirements;
- Violates these Terms;
- Engages in unsafe or disruptive behavior;
- Misuses the Services.
Participants may discontinue participation at any time by contacting the Mobility Transport Program.
13. Electronic Communications
By registering for the Services, participants consent to receive communications by email, text message, telephone, or mobile application regarding ride scheduling, service alerts, program updates, and other administrative communications.
14. University Policies
Use of the Mobility Transport Program is also subject to applicable:
- University of California policies;
- UCSB campus regulations;
- Student Code of Conduct;
- Information technology and acceptable use policies; and
- Other applicable University rules governing use of campus services.
If these Terms conflict with applicable law or University policy, the applicable law or University policy shall control.
15. Entire Agreement
These Terms, together with the Mobility Transport Program Privacy Policy and applicable University policies incorporated by reference, constitute the entire agreement governing your use of the Services.
